ConnectESL Terms of Service

1. Introduction

Welcome to ConnectESL. By accessing or using the ConnectESL website (the "Site") and services provided through the Site (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Services.

2. Eligibility

To use the Services, you must be at least 18 years old and capable of forming a legally binding contract. By using the Services, you represent and warrant that you meet these requirements.

3. Account Registration

To post a job or use certain features of the Services, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account password and for all activities or actions that occur under your account.

4. Job Posting

Users may post ESL teaching job opportunities ("Job Posts") on the Site subject to the following conditions:

• Accuracy: You must provide accurate and truthful information in your Job Posts. You are solely responsible for the content of your Job Posts.
• Prohibited Content: You agree not to post any Job Posts that contain misleading, offensive, defamatory, or illegal content. This includes, but is not limited to, content that is discriminatory, harassing, or otherwise inappropriate.
• Right to Remove Posts: ConnectESL reserves the right, at its sole discretion, to remove any Job Posts that violate these Terms or are otherwise deemed inappropriate or misleading.

5. Payment and Fees

Posting a Job Post on the Site requires payment of a fee as specified on the Site at the time of posting. In addition to standard job postings, users may purchase additional services, including but not limited to "Featured Status" for job postings or "Job Credits" for future postings.

• Featured Status: This option highlights your job posting for increased visibility on the Site. The fee for this service is outlined at the time of purchase.
• Job Credits: Users can purchase Job Credits, which can be used to pay for job postings at a later date and do not expire. Job Credits are non-transferable.

All fees for job postings, Featured Status, and Job Credits are non-refundable, except as outlined in the Refund Policy below. ConnectESL reserves the right to change its pricing and payment terms at any time, and any such changes will be posted on the Site.

6. User Conduct

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable laws or regulations.
• Use the Services for any unauthorized or unlawful purpose.
• Engage in any activity that could interfere with or disrupt the Services.

7. Intellectual Property

All content and materials available on the Site, including but not limited to text, graphics, website name, code, images, and logos are the intellectual property of ConnectESL and are protected by applicable copyright, trademark, and other intellectual property laws. Unauthorized use of any materials found on the Site is strictly prohibited.

8. Limitation of Liability

To the fullest extent permitted by law, ConnectESL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the Services.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any content posted by other users, including any defamatory, offensive, or illegal content.

9. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis. ConnectESL makes no representations or warranties of any kind, express or implied, as to the operation of the Services or the information, content, or materials included therein. You expressly agree that your use of the Services is at your sole risk.

10. Refund Policy

All fees paid to ConnectESL for job postings, Featured Status, Job Credits, or any other services are generally non-refundable. Refunds will only be considered under the following circumstances:

• Technical Issues: If a technical issue with the ConnectESL site prevents your job posting from being displayed as intended or if a purchased service is not delivered due to a site malfunction, you may be eligible for a refund.
• Discretionary Refunds: Any requests for refunds due to technical issues must be submitted in writing to ConnectESL within 3 days of the occurrence of the issue. ConnectESL reserves the right to review and verify the issue and to determine, at its sole discretion, whether a refund is warranted.

If a refund is granted, it will be processed using the original method of payment after the refund has been approved.

Please note that refunds are not available for any other reasons, including but not limited to changes in hiring needs, user error in posting, or dissatisfaction with the site's performance.

11. Indemnification

You agree to indemnify and hold harmless ConnectESL, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorney’s fees and costs, arising out of or in any way connected with:

• Your access to or use of the Services.
• Your violation of these Terms.
• Your Job Posts.

12. Termination

ConnectESL reserves the right to suspend or terminate your account and/or access to the Services at any time, without notice, for conduct that ConnectESL, in its sole discretion, believes is in violation of these Terms or is harmful to the interests of another user, a third party, or ConnectESL.

13. Changes to the Terms

ConnectESL reserves the right to modify or update these Terms at any time without prior notice. Your continued use of the Services after any changes constitute your acceptance of the new Terms. It is your responsibility to review these Terms periodically.
